As Holistic Ozone, we attach great importance to the processing and protection of the personal data of our customers, potential customers, and website visitors in accordance with the relevant legislation, primarily the Constitution of the Republic of Turkey and the Law on the Protection of Personal Data No. 6698 ("KVKK").

This Clarification Text has been prepared by Holistic Ozone, in the capacity of Data Controller pursuant to Article 10 of the KVKK, to inform you about the methods of collection, purposes of processing, legal reasons for your personal data, and your rights.

1. Identity of the Data Controller

Pursuant to the KVKK, your personal data may be processed by Holistic Ozone ("[Company Title]"), as the data controller, within the scope described below.

2. Your Processed Personal Data and Purposes of Processing

Your personal data in the categories of identity, contact, customer transaction (order history, billing information, etc.), and transaction security (IP address, website log-in/log-out information) are processed for the following purposes:

  • Presenting our products and services, carrying out order processes, and ensuring delivery,

  • Carrying out after-sales support and customer relationship management processes,

  • Invoicing and tracking finance/accounting operations,

  • Provided that you have given your explicit consent; informing you about campaigns, discounts, promotions, and our new products (sending e-newsletters, SMS, and e-mails),

  • Ensuring the security of our website and improving the user experience,

  • Fulfilling our legal obligations arising from the relevant legislation (Law on the Protection of the Consumer, Regulation on Distance Contracts, etc.).

3. To Whom and for What Purposes Personal Data May Be Transferred

Your collected personal data, in line with the realization of the purposes stated above and in accordance with Articles 8 and 9 of the KVKK, may be transferred:

  • To cargo and logistics companies for the purpose of carrying out delivery processes,

  • To banks and payment institutions for the purpose of carrying out financial transactions and payments,

  • To relevant software companies and our financial advisors for e-invoice and accounting processes,

  • To our business partners sending bulk e-mails/SMS in line with your marketing permission (explicit consent),

  • To legally authorized public institutions and organizations and judicial authorities (in case of a legal obligation).

4. Method and Legal Basis for Collecting Personal Data

Your personal data is collected through the forms you fill out on the Holistic Ozone website, membership registrations, call center calls, e-mail communications, and social media channels, in electronic or physical environments, by fully or partially automatic means or by non-automatic means provided that they are part of any data recording system.

These data are processed based on the following legal grounds specified in Article 5 of the KVKK:

  • It is expressly provided for by the laws,

  • It is necessary to process the personal data of the parties to a contract, provided that it is directly related to the establishment or performance of the contract (e.g., Distance sales contract),

  • It is mandatory for the data controller to fulfill its legal obligation,

  • Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject,

  • Having your explicit consent for marketing and commercial communication activities.

5. Rights of the Personal Data Owner (Data Subject) Under Article 11 of the KVKK

Pursuant to Article 11 of the KVKK, as a data owner, you have the following rights:

  • To learn whether your personal data is processed or not,

  • To request information if your personal data has been processed,

  • To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

  • To know the third parties to whom your personal data is transferred domestically or abroad,

  • To request the correction of your personal data in case of incomplete or incorrect processing and to request the notification of the transaction made within this scope to the third parties to whom your personal data has been transferred,

  • To request the deletion or destruction of your personal data in the event that the reasons requiring its processing disappear, despite having been processed in accordance with the provisions of the KVKK and other relevant laws,

  • To object to the occurrence of a result against the person themselves by analyzing the processed data exclusively through automated systems,

  • To demand the compensation of the damage in case you suffer damage due to the unlawful processing of your personal data.
